Councilman Hilbert and neighbors:
Once again Crisis Pregnancy Center has returned with essentially
the same proposal they initially presented back in 2001, which
was strongly opposed by the two abutting neighborhood associations
(Bellevue and Ginter Park) and soundly defeated in public hearings
at Planning Commission and Board of Zoning Appeals. As part of the
"institutional memory" here I have the files and paperwork from their
previous attempts to establish operations at this site, so I would be
happy to meet with you to discuss a response by the Bellevue Association.
Let me assure you that BCA met several times with CPC staff and provided
a fair and impartial sounding board to their proposal before taking a
position
that opposed specific aspects of the proposed uses. At a neighborhood
meeting
called specifically to provide a public discussion of their proposal,
nearly 100
Bellevue residents in attendance voted overwhelmingly (4 to 1 margin) to
adopt
that position.
I am happy to share my remarks to BZA (Feb 5, 2003), a letter to Council
(2002)
and remarks to Planning Commission (in 2001) which summarize our
association
response the last time CPC made this application. They provide a partial
history
of CPC's efforts to wear down the opposition through repeated delays of
their
public hearings.
When CPC determined they were going to be defeated at
Council,
as they had at BZA and Planning Commission, they pulled their appeal less
than an
hour before the Council meeting on May 28, 2002. That was just one of
several
delaying tactics used by CPC and their attorneys, who have also asked for
repeated
continuances in Circuit Court in the past two years.
I strongly caution
you that, in my
opinion, CPC and their attorneys have used
obvious diversionary tactics to
delay and
divert public participation by the
neighboring property owners and
associations in
this very public process.
We have never opposed their use of the building
as allowed
by the current
zoning, and in fact they have operated there within the
zoning for
nearly
two years. But once again they are back asking for inappropriate
and
incompatible uses.
